Through a unsigned order, the highest judicial body permitted Texas to employ a revised congressional map that may create several five new conservative-tilting districts. The six-to-three ruling, issued on Thursday, upholds a petition by the state to set aside a federal judge's ruling that had rejected the boundaries in November.

Justices' Explanation

The federal judge erroneously placed itself into an ongoing primary campaign, causing significant confusion and disturbing the sensitive federal-state balance in elections, the supreme court said in explaining its action.

That lower court had determined that Texas had probably classified voters based on their race – a practice known as unconstitutional racial sorting – when it passed the new maps. It had mandated the state to revert to the districts established after the 2020 census for the upcoming election.

Sharp Dissent

With a strongly worded dissent, Justice Elena Kagan took issue with the majority's decision. She stated that it disrespected the work of the lower court, observing that its decision was actually authored by a judge nominated by former President Donald Trump.

Our position is above the district court, but our capability is not greater for resolving such fact-driven issues, Kagan stated in a opinion joined by Justices Sonia Sotomayor and Ketanji Brown Jackson.

The justice went on, This court's stay ensures that Texas's redistricting plan, with all its enhanced partisan advantage, will govern next year's elections. And it guarantees that many Texas voters, unjustly, will be grouped in electoral districts because of their race. And that result, as this court has stated consistently, is a violation of the constitution.

National Redistricting Struggle

The ruling occurs during a countrywide contest over the remapping of electoral maps. Texas is a key piece in pushes to reshape the U.S. House map to bolster a fragile Republican control. Typically, boundary revision takes place after a new decade's census. Yet the move by Texas Republicans to proceed with a brazen mid-cycle redistricting earlier in the summer sparked a wave among other states.

Conservative legislators in states like North Carolina and Missouri have also approved redistricting plans that might create a number of additional GOP-friendly seats. Democrats, meanwhile, have countered with revised boundaries in including California and Virginia, which are intended to balance those potential gains.

Political Responses

A senior House leader stated the court had another time shredded its standing by upholding a discriminatory map. Tonight's ruling by far-right justices on the supreme court is further proof that the extremists will do anything to rig the midterm elections. The gerrymandered Texas congressional map is a partisan and racially discriminatory power grab designed to subvert the will of the voters – particularly in Black and Latino communities, he added.
